Your Check Bounced
                As the summer of 2010 comes to an end, we add yet another contractor to our list, "yes your check bounced". A company called Castle Air Conditioning Corp. and its owner Emil Ruddick. Mr. Emil Ruddick signed a contract with Smith HVAC
to complete shop drawings for one of his jobs located at 780 Lexington Avenue floors 7 and 14. Click below to see a copy of the contract that was signed by Smith HVAC and Castle Air Cond.

               When Smith HVAC completed the drafting project we called Mr. Emil Ruddick to receive our final payment. Only then, at the end of the job, did he request we provide him with proof of workers compensation Insurance. We did provide him with workers compensation insurance. Under State law Smith HVAC is not required to carry workers comp. insurance since we did not have any employees at the time.

               Mr. Ruddick then wrote a check for half of the final amount due and put a notation at the bottom of the check that
the rest will be paid when proof is given of workers comp. Insurance. Well that check bounced.

               Sick and tired of calling Mr. Ruddick, going to his office
where he made me wait outside in 100 degree heatwave, bounced
checks, arguing pointlessly over the phone, Smith HVAC sued Castle Air Conditioning in small claims court for the balance due a mere 250.00 dollars. He gave the same argument to the arbitrator (proof of workers Comp. insurance was needed). Smith HVAC's argument was simply, with the contract that both men signed, your word (verbal writen word/contract) is your bond, one party of the two, must not be allowed to breach a contract, add to it, or formulate their own contract from the one that exists allready. To ask to see proof of workers comp or general liability insurance at the very end of our agreed task and then not pay is stealing. The arbitrator agree. Judgement was awarded to Smith HVAC.

               30 Days after the Judgement was rendered by the Court, Caste AC Paid the amount due. I warn all don't do business or work for this intity. Emil Ruddick is a special type of thief. I will spend this the judgement amount investing in a campaign adveretising to the world against Castle Air. shut them down to see that this doesn't happen to anyone else. Emil Ruddick/ Castle Air Conditioning, I am proud to have you in my club, your check bounced. You are a special type of pig.
